SBA 8(a)

First Line Technology is a U.S., minority owned, Small Disadvantaged Business (SDB), with Small Business Administration (SBA) certified 8(a) credentials through January 2014.

  • The 8(a) Program -- named for Section 8(a) of the Small Business Act – is a business development program created to help small disadvantaged businesses compete in the market place. It is also designed to assist such companies in gaining access to federal and private procurement markets.
  • The focus of the program is to provide business development support, such as mentoring, procurement assistance, business counseling, training, financial assistance, surety bonding and other management and technical assistance. The goal, however, is to prepare small disadvantaged firms for procurement and other business opportunities.

In response to events regarding the H1N1 influenza in the spring of 2009, the Department of Homeland Security (DHS) was appropriated the funding for preparation, planning, and mitigation of an influenza pandemic. First Line Technology has been awarded a multiple-award Indefinite-Delivery, Indefinite Quantity (IDIQ) contract with the DHS Office of Health Affairs (OHA) for respirators. The contract is for N95, N99, and N100 respirators for the purpose of H1N1, avian influenza, and pandemic influenza preparedness for DHS personnel. First Line has partnered with Louis M. Gerson and Co. to deliver high-quality respirators that are made in the United States of America. All respirators are NIOSH- and FDA-approved where applicable.

Ordering Procedures - FAR 16.505

The DHS Ordering Guide for the Respirator Pandemic Stockpile IDIQ can be found on DHS' PRISM system.

DHS/OHA has already negotiated contract pricing effective 2/1/2010 to 1/31/2011 with volume discounts at 100,001 and 500,001 units. This vehicle is available on a DHS-wide basis to all contracting activities of the DHS. Any DHS Contracting Officer may issue orders under this contract subject to the limitations of their warrant and procurement office policies. It is a contracting vehicle only and the funds must be allocated from the individual agency's budget. Contract pricing is FOB Destination.

  1. Delivery orders <$3,000 can be issued to any awardees for the contract price without open competition.
    • Contracting officer must reference First Line's IDIQ contract number HSHGDC-10-D-00010 on his/her purchase orders.
  2. Delivery orders >$3,000 must be bid out to all awardees and pricing must be less than or equal to contract pricing.
    • Contracting Officer at DHS component agency will put out a Delivery Order Request for Proposal (DO-RFP) to all IDIQ awardees that states the delivery location and the basis for award.
    • IDIQ awardees may offer item prices less than what is stated in the IDIQ.
    • Each Delivery Order (DO) will be awarded based on:
      • Lowest Price Technically Acceptable

        or
      • Trade Off Process (specific evaluation criteria specified in DO-RFP)
    • DOs may be awarded to multiple vendors
  3. For Deliver Orders >$500,000, the issuing agency is required to provide a proposal debriefing to all responding companies.

Exceptions for Sole Source Justification - FAR 16.505 (b)(2)

The Contracting Officer shall give every awardee a fair opportunity to be considered for a delivery order or task order exceeding $3,000 unless one of the following statutory exceptions applies:

  1. The agency's need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays;
  2. The order must be issued on a sole-source basis in the interest of economy and efficiency as a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order (i.e.: fit testing conformity).

 

Product Technical Requirements

All filtering facepiece respirators supplied under this IDIQ will be used in an occupational setting to comply with Title 29 Code of Federal Regulations (CFR) Part 1910.134, Respiratory Protection and shall be NIOSH-approved in accordance with 42 CFR Part 84 for occupational use.

  1. N95 Filtering Facepiece Respirators
    • Cup-shaped with exhalation valvle
    • Cup-shaped without exhalation valve
    • Flat fold with exhalation valve
    • Flat fold without exhalation valve
  2. N99 Filtering Facepiece Respirators
  3. N100 Filtering Facepiece Respirators
  4. Surgical N95 Filtering Facepiece Respirators are also FDA-cleared through 510(k) by the FDA as surgical masks and surgical apparel as defined under 21 CFR 878.4040.
